Legally sound documentation in winter service – why GPS stamps and timestamps decide claims
A fall on an uncleared pavement. A call from the lawyer. The question: can you prove that your driver cleared Musterstraße at 5:30 a.m.? What many winter service businesses only realise when it really matters: without seamless documentation, they stand in court empty-handed.
Why documentation in winter service is not optional
The duty to clear and grit is regulated by law. Anyone who fails to meet it – or cannot prove that they met it – is liable. That sounds clear-cut, but in practice it is more complicated than expected.
The decisive point: In a claim, the winter service business must prove that the job took place. The burden of proof lies with the business – not with the injured party.

- Where the driver was at the exact moment
- When they arrived at and left the site
- How long the job took
- Which route they drove

Timestamp – the difference between safety and risk
The time is often the decisive criterion in winter service. Applicable clearing times are clearly regulated in many municipalities – for example from 7:00 a.m. on working days. If an accident happens at 7:15 a.m. and your driver demonstrably cleared at 6:55 a.m., you are on the safe side.
